Mohegan Lake Legal Defense Fund

History of this site

This site was originally set up to fight 3 of 5 zoning variances proposed by the FBC development at Sagamore Trail and Mohegan Ave that eliminates two single family homes while nearly quadrupling the parking and occupancy loads of the old Lakeland Jewish Center. That effort failed and the application is currently before the Planning Board.

While Save Mohegan Lake will continue to update you on that issue, we are moving on to all issues affecting the lake, such as Mohegan Lake Improvement District (MLID) meetings, agenda and budget. This site is not an official mouthpiece for MLID, but some updates will be provided on this site; the official site is located here.

We do it all here, so long as it's Mohegan Lake related. Feel free to submit comments, content, garage sale notices, police blotters, PSA's, essays on the virtues of our 105 acre ice rink, rants, raves, etc... We love it all.

Holland Club Notice of Violation

Yorktown received a violation for the half-assed demo job they did at the Holland Club.  Much more to follow.  In the meantime, you can follow along at home by liking Friends of the Holland Club on facebook, here.

Deep Breaths

There's a whole lot going on up here in Mohegan Lake and it sure can get stressful. We have to remember to take a few deep breaths occasionally and keep things in perspective.  Think about how this late blast of winter is going to make spring seem that much sweeter.

A quick recap of all things Mohegan Lake:

Hectic indeed, but  I'm now thinking back to simpler times, just a few short weeks ago when I was simply a father, clearing an ice skating rink for my girls. That's my happy place.  Should get me through til next winter!

Hard work, but totally worth it.

Yes, that is the Holland Club property in the background.

Going places.

We've got moves.

Recapping The Holland Club Proposal

  •  Michael Grace, Yorktown supervisor has proposed using 86,000 cubic yards (about "6,000 dump trucks worth," according to planning director, John Tegeder).
  •  There is no site plan for the proposal.
  • This work has to begin when the widening of route 202 begins in April; the state has offered the fill and labor to "back blade and roll" the dirt around.
  • The Holland Club Property is one of the most beautiful properties in Yorktown, if not the count, according to supervisor Grace.  Yet we should dump 6,000 dump trucks worth of "clean" fill to clear cut huge swaths of trees, negate the steep slopes and cover the natural beauty of the rock on the site?
Will they plant it?  If not, how badly will the sediment runoff affect the trouble Mohegan Lake?   Can we promise not to fertilize the fields so that we don't exacerbate the perennial blue-green algae bloom that closed the lake to swimming for the season beginning in July?

Below is a photo of Mohegan Avenue where the lake outflow is taken tonight on my way to George Washington's K-2 open house with the family.  Please note that the lake edge extends over the double yellow line dividing the two, tight driving lanes.  Can we use 1 thousand of the 86,000 cubic yards of fill to create a berm and repave the road so we don't have to drive through 1-2 feet of water in the eastbound lane?

If you want to stay apprised of the goings on, like our facebook page: Friends of The Holland Club.

I know you already like Save Mohegan Lake's page, right?

Holland Club Site Visit

There will be a site visit to review the condition of the remedial work prompted by the NYSDEC Notice of Violation, general discussion of the property and fellowship.  For those interested in attending, it will begin at 11am on Saturday, 4/6/2013 unitl 11:30ish.  Hope to see you there.  If you haven't been to the site, or haven't been recently, I highly recommend you take a look-see.  It's a great property. We've had an eagle and osprey sightings on the lake (they were both fishing).  There are at least 3 great blue heron and about 100 or so Merganser ducks chilling in the lake for another couple weeks.

Please note that the Town Board will be discussing the park proposal approved by the Recreation Commission on Tuesday night at the Town Board.  You should attend this meeting if you have an interest in the future of the Holland Club.
They literally turned the Holland Club into a dump, without a permit.   That's the gist of the violation.  There's been some funny semantic games, contradictions and outright opacity from the board regarding this issue.

Friends of The Holland Club

This is a link to the facebook page set up this morning to coordinate a community response to recent informal announcement regarding the proposal to clearing woodlands in the Holland Club and dump "tens of thousands of yards" of dirt from the Route 202 widening to make fields.  Fields no one asked for, not to mention the site can't support parking or traffic required for such; not to mention destroying one of the little slices of natural beauty we are left with in Mohegan Lake.  Thanks for the offer, Supervisor Grace, but no thanks.  Last thing we need is another half-baked project for Parks and Rec that won't get complete and will detrimentally impact residential quaility of life for the surrounding community. Maybe you can use that clean for the Costco site fill.

Please keep your hands off of the Holland Club. Thanks.

They're Coming for The Holland Club!

It was only a matter of time.  I'm just surprised they literally just want to dump on us up here in Mohegan Lake.

A message from MLID president Ken Belfer:

I was informed tonight after the Town Board meeting that the widening of Route 202 is supposed to begin in April, and the Town has been offered tens of thousands of yards of clean fill that will be excavated.  Supervisor Grace informed me that they would like to have it all brought to the Holland Club property.  His vision was that all the Town would have to do is cut down the trees in a portion of the property, and they would get the fill brought over and graded for free.  He felt it would clean up the property and create two town ballfields at the same time.  He said one would be at the lake level, and there would be an open grassy area leading up to the lake with a lake view.  The other would be at the top.  I was told that this plan would be presented at the Rec Board meeting on the 14th of March, and that the Town had to move fast to take advantage of this offer.  He wanted lake residents to know about this, and to come out to the Rec Board meeting to hear about it and give input.
I wanted to get the word out about this right away, because I know there will be very strong feelings about this.
And please, don't shoot the messenger . . . .
Ken

Elephant In The Room: The Holland Sporting Club

Arguably the most important issue facing the future of Mohegan Lake?  The Holland Sporting Club.  The fate of this beautiful acreage, which is supposed to end up as passive recreation for the surrounding residential community (and all of Yorktown residents), is still up in the air.

Unsure where the Holland Sporting Club is?  Below is a map with a pin showing you the entrance.  It's basically the peninsula structure jutting out into Mohegan Lake.

Yorktown recently demolished about 11 buildings which comprised the original Holland Sporting.  There was some controversy, as there always is with anything in this town.

If anyone thinks this issue is settled is mistaken. It's quite possible, especially under the current administration, we may see a "private-public partnership" that sees us giving it all, or a portion, away to a private developer.

Nothing is certain.  This is an issue that every Mohegan Laker ought to concern themselves with.  No definitively plans have been put forth, and it's all napkin sketches at this point.  Keep your eye on the ball.

Holland Sporting Club Clean Up

Remember the still open DEC violation for the Holland Sporting Club/Rock Hill? It looks like the town is finally footing the bill to complete the clean up.  Welcome news.  It sure took much longer--and at a greater cost to taxpayers--than originally advertised, but hopefully it gets done right now.  It's such a beautiful property.

There Oughta Be a Law...

Oh, wait, there actually already is a law.

I've written extensively about the egregious violations of the Yorktown Code that occur immediately adjacent to my family's home.  I wrote dozens of correspondence to the Yorktown Building Department and Code Enforcement office over a 2 year period.  I supplied all of the town records of the Assessor and Building Department showing that the two houses next to my house are--in fact--still legally houses and were illegally converted to enlarge a very small church to a much bigger one.   I never once received a courtesy of a reply and the owner that violated the law and continues to do so gets off Scott free.  In fact, they are using the illegal conversion which drastically altered the character of this small residential community to make an argument that the they should be allowed to triple it without increasing parking.

This weekend, there were three things that brought it all into focus for me:

1)  I was reading The Yorktown News (that paper you get in the mail and doesn't publish online) about the new garbage hauler, Competition Carting.  It was a mostly complimentary article (I've been satisfied with them so far), but near the end, it stated that the Competition  was parking their trucks on a parcel that does not have the requisite special use permit to park trucks.  It went on to state that the Yorktown Code enforcement office Jason Zeif sent a notice of violation to the property owner.  I point out nearly an identical case of an owner needing a special use permit and operating without it for years and the Town is silent.  These trucks are parked like this for 2 weeks and the town issues a violation.  It appears that the only place the town enforces its laws are in Yorktown Heights!

2)  I was speaking with the president of one of the 7 Home owners association yesterday (I'm vice president of the Mohegan Highlands Property Owners Association).  I was ice skating on the lake, he ice fishing.  After a long discussion about local politics, development, the Holland club (don't you dare try to do anything but passive recreation there, Yorktown!) , he said "they [Yorktown government officials] treat us like second-class citizens."  I've only lived here a few years, but I have to agree with the spirit of his sentiment.
Fresh tracks on Mohegan Lake 1/26/2013

3)  A commenter on another subject on the Patch pointed out that Mohegan Lake has not really had a representative on the Town Board since 2000.  It feels like most of the TB members familiarity barely extends beyond Route 6 which is probably the most blighted of the entire area; an area that is predominantly residential.

That said, I'm running for the Yorktown Town Board this year.  I'm doing it for two specific reasons:

1)  I want to bring a voice to the board for residents of Mohegan Lake and Shrub Oak.  This area is more dense population-wise because the area is zoned much smaller than Yorktown Heights, yet 100% of the Town Board lives on the "south side."  I think that needs to change and we can do it.

2) I have an architecture degree from the Cooper Union and have worked for the last 12 years in New York City as a building code and zoning consultant.  This period was the biggest overhaul of their system bringing about more accountability, transparency while streamlining the approval and building process. This experience uniquely qualifies me as a person who can take the initiative to revamp Yorktown's antiquated and outmoded building department.

Originally being from Colorado, with it's strong libertarian bent, I'm choosing to run independent.  I don't want the baggage that comes with the entrenched Democratic and Republican parties.

Reminder: Faith Bible Church Planning Board Hearing Tonight 5/6/2013 at 7:30pm at Town Hall

Don't forget about this public hearing tonight.  It's only THE most important facing Mohegan Lake today (now that we quashed that crazy Holland Club ball field proposal).  I guarantee it will be epic. Make sure you've been fed and have a snack; it will probably take a while.

Solid Beaver Evidence

Took a trip to the Holland Club this weekend.  Me and the girls took a tour of the site and made a few fun discoveries.  We found fresh, solid evidence of a beaver in the lake.  The town has been trapping them to help mitigate the outflow issues.  Did you know the beaver was adopted as the New York state animal in 1975?

Weekend Wrap Up

Wow.  It sure is special when the lake freezes and--even if for just a few brief days--we have a very different and intimate experience of Mohegan Lake; from ice fishing to skating, it's a beautiful asset for the whole lake community.

Alone with his thoughts, and some frozen fishes.  In the distance, the Holland Sporting Club property.

It's important that the Shrub Oak Lake Estates (SOLE) home owners are cognizant that, in addition to the parking at the SOLE beach, they have a permanent deeded right to park on another lakefront lot "at all times" and "at no cost."  When SOLE sold this parcel to the Lakeland Jewish Center (now Faith Bible Church [FBC]), it stipulated 5 permanent terms and conditions when they sold it to Lakeland Jewish, and those terms still carry the weight of law.   I only mention it because some of the legally required signage indicating the SOLE member parking seems to have gone missing.  The deed restrictions clearly state such signage should be present; just be aware it is available for SOLE members to use in addition to FBC members.   You can read the history of that parcel here.  [Click "read more" below to continue reading]

Maps!

So...I made my 8+ month pregnant wife make us some maps from the Westchester County GIS database tonight.  She really turns me on like that.  She even broke out the 2 Foot Topos.

It's important that the public has some context as to where the 86,000 cubic yards of "clean" fill will be deposited in Yorktown..  The site is extraordinarily unique.  I would mention that Jones Hill (top right of the first image below), may be a little more unique-er.
